Special Development Contribution & voluntary organisations

In case reference PL04 .246387 regarding 3 new schools in Ardnacloghy, Carrigaline, Co. Cork, and decided on 16th September, 2016, the Board imposed a Special Development Contribution under Section 48 (2)(c) of the Act towards road works that would facilitate and benefit the proposed development. In doing so, the Board was of the opinion that the principles of Cork Institute of Technology -v- An Bord Pleanála [2013] IEHC 3 related solely to the content of the General Development Contribution Scheme, and to its proper interpretation, and not to the imposition of a Special Development Contribution under Section 48 (2)(c) of the Act, whether or not it was a voluntary organisation and whether or not it paid a planning application fee
